BUM PARK CATASTROFE FINANCIERA

A fines de diciembre del 2016 el Sr. Bum Park, presidente del BOD de DI, declaró bancarrota. Revisando el reporte público del mismo, US Banruptcy Court case #1626718-LMI, vemos una lista  larguísima de deudas a tarjetas de crédito y a otros acreedores.

Pero lo mas interesante es que el presenta su caso días después que dos directores del BOD, Jaime Correa y Marcelo Ali, presentaron una demanda en la corte referente a su mora en los pagos a la Asociación DI por mas de 90 días en dos ocasiones, lo cual lo incapacitaba para seguir siendo miembro de la directiva, de acuerdo a F.S. 720.306(9)(b) “A person who is delinquent in the payment of any fee, fine, or other monetary obligation to the association on the day that he or she could last nominate himself or herself or be nominated for the board may not seek election to the board, and his or her name shall not be listed on the ballot. A person serving as a board member who becomes more than 90 days delinquent in the payment of any fee, fine, or other monetary obligation to the association shall be deemed to have abandoned his or her seat on the board, creating a vacancy on the board to be filled according to law…”

No  había mas discusión Mr. Bum Park estaba afuera del BOD. Pero su declaración de bancarrota limpia toda reclamación (es increíble). Buen truco legal con la ayuda del abogado de la asociación pagado por la Membrecía.

No solo que Mr. Bum Park no podía ser elegido miembro del BOD, no podía votar, pero ni siquiera podía entrar al club, por la mayor parte de los años 2015 y 2016 mientras debía dinero a la Asociación. Fíjense en los By Laws: “7.1.3    Enforcement. Suspend the right of use of the Common Areas (other than for vehicular and pedestrian ingress and egress and for utilities) of a Member during any period in which such Member shall be in default in the payment of any Assessment or charge levied, or collected, by Association.”

Mr. Bum Park y su entorno no tienen derecho, ni cara, para presentarse de candidatos a la elección venidera.
